On May 12 1998 the regional court (LG) Hamburg decreed that website providers can be held responsible for the contents of any linked pages. According to LG Hamburg, the only way to disclaim responsibility is to expressly distance oneself from the contents of the websites in questions.
IUBH has set up links on their website. With these references to external websites which lie outside the sphere of IUBH’s responsibility, a liability obligation would only become effective in the event that IUBH has knowledge of the contents and it would be technically feasible and reasonable to expect IUBH to prevent the usage of the external website in the event of illegal contents.
IUBH expressly declares that at the time of activating the links there was no illegal contents on the linked pages. IUBH has no influence whatsoever on the current and future design and contents of linked pages. Therefore, IUBH hereby explicitly dissociates itself from all contents of all linked pages that were modified after the activation of the link. This declaration is valid for all links and references within its own internet site as well as for any external entries in guest books, discussion forums and mailing lists.
Liability for any illegal, incorrect or incomplete contents and in particular for damages which result from the use or non-use of such information, lies exclusively with the provider of the site to which these links refer, and not with the one who merely refers to the respective content via links.
